ECHO TERMINAL | TERMS OF SERVICE
1. Agreement
> By using Echo, you agree to these Terms of Service. If you do not agree, please do not use Echo.
2. Description of Service
> Echo allows you to transmit text and receive a generated response called an Echo.
> Echo may also provide features such as an Echo archive, The Void, Pulses, rewards, transmission allowances, and other terminal-related features.
> Features may change as Echo is updated.
3. Anonymous Access and Beacons
> Echo is designed to be used without creating a traditional named account.
> The service may use anonymous identifiers to operate the app, maintain your Echo experience, prevent abuse, process entitlements, and provide app features.
> Public content displayed in The Void uses an anonymous public Beacon identifier. A public Beacon is not intended to reveal your real-world identity.
> You must not attempt to identify, track, or expose another Echo user's identity.
4. Transmissions and Generated Echoes
> When you submit a transmission, Echo may process that text to generate an automated response.
> Generated Echoes may be inaccurate, incomplete, unexpected, offensive, or otherwise unsuitable. You should not rely on an Echo as a statement of fact or as professional advice.
> Echo is not a substitute for medical, mental-health, legal, financial, emergency, or other professional services.
> You remain responsible for the text you submit and how you use any generated response.
5. The Void and Public Content
> You may choose to cast eligible content into The Void.
> When you confirm a Cast to Void action, your transmission and its associated Echo become publicly visible in The Void and may also be displayed on Echo's public website.
> Public Void content is displayed with an anonymous public Beacon identifier and may include information such as the Echo, transmission, creation time, and Pulse count.
> Do not cast content that contains personal information, confidential information, or information you do not want made public.
> PenguinWorks may moderate, hide, remove, or decline to publish content where necessary for safety, abuse prevention, legal compliance, or operation of the service.
6. Pulses and Community Features
> Echo may allow users to Pulse content available in The Void.
> Pulses are lightweight interactions and do not create ownership, endorsement, or a private relationship between users.
7. Terminals, Transmission Allowances, and Rewards
> Echo provides different terminals or plans with different transmission allowances.
> The Orbital-24 terminal allows 1 transmission per 24-hour orbit. The Nebula-12 terminal allows 5 transmissions per 24-hour orbit.
> Your available transmission count may depend on your current terminal, orbit, subscription status, and eligible rewards.
8. Purchases and Subscriptions
> Echo may offer paid features or subscriptions.
> Purchases made through the Apple App Store or Google Play are processed by the applicable platform and are subject to that platform's payment, renewal, cancellation, and refund terms.
> PenguinWorks does not directly process App Store or Google Play payment credentials.
9. User Conduct
> You agree not to use Echo to:
> - Submit or publish illegal, threatening, abusive, hateful, exploitative, or intentionally harmful content
> - Publish another person's private or confidential information without permission
> - Attempt to identify or expose another user's identity
> - Abuse, manipulate, probe, scrape, or interfere with Echo or its infrastructure
> - Circumvent transmission allowances, subscriptions, moderation, or security controls
> - Use Echo in a way that violates applicable law or the rights of others
> PenguinWorks may restrict access or remove public content when these Terms are violated.
10. Intellectual Property
> Echo's software, design, branding, interface, and other materials provided by PenguinWorks are owned by or licensed to PenguinWorks and are protected by applicable intellectual-property laws.
> You may not copy, redistribute, reverse engineer, or commercially exploit protected Echo materials except where permitted by law or with written permission.
11. Availability and Changes
> Echo is provided on an evolving basis. Features, terminal allowances, rewards, generated-Echo behavior, public features, and availability may change over time.
> PenguinWorks may modify, suspend, or discontinue part or all of the service.
12. Disclaimer
> Echo is provided "as is" and "as available" without warranties to the extent permitted by law.
> PenguinWorks does not guarantee uninterrupted availability, preservation of content, accuracy of generated Echoes, or that every Echo will be appropriate for every user.
13. Limitation of Liability
> To the maximum extent permitted by applicable law, PenguinWorks will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of or inability to use Echo.
> Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
14. Changes to These Terms
> We may update these Terms when Echo, its features, or applicable requirements change.
> The current version and its last-updated date will be made available through Echo or the PenguinWorks website.
